Article 01 Scope |
|
These Terms and Conditions of Sale govern orders entered into between the seller identified in the legal notice of suissepliage.ch (the "Seller"), and any person or legal entity placing an order (the "Customer"). Every order implies acceptance of the Terms in force when it is confirmed. |

Article 02 Products and custom manufacture |
|
SuissePliage offers folded sheet metal parts, building flashing items, metal cladding for facades or roofs, and parts manufactured according to dimensions provided by the Customer. Products configured with the Customer's dimensions, materials, thicknesses or finishes are custom-made products. |
|
Article 03 Order and dimensional responsibility |
|
The order becomes binding after cart confirmation, acceptance of these Terms and payment confirmation in accordance with the selected method.
The Customer is responsible for entered choices. Unless an engineering service is expressly agreed, the order does not include design or sizing verification. |

Article 04 Cancellation and customised products |
|
A made-to-measure or customised product cannot be cancelled, returned or refunded because the Customer changes their mind after order confirmation. Important reservation: this rule does not restrict rights relating to defective or non-conforming products or any applicable mandatory rights. |
|
Article 05 Manufacturing tolerances |
Variations within these tolerances and minor colour differences between coating batches do not, by themselves, constitute non-conformity. |

Article 06 Prices |
|
Prices are displayed in Swiss francs (CHF). Unless stated otherwise in the order, they exclude installation, engineering studies, unlisted accessories and special delivery services. The applicable price is the price displayed and accepted when the order is confirmed. |
|
Article 07 Payment and start of manufacture |
|
Payment is due when the order is placed. Offered methods may include bank card, bank transfer and PayPal; only options displayed at checkout are available for the relevant order. Manufacture of a customised item starts only after payment confirmation. |
|
Article 08 Lead times |
| Unless an express commitment is accepted in writing, stated lead times are estimates. Delays may result from manufacture or transport. Rights and remedies which cannot be excluded under applicable law remain reserved. |
|
Article 09 Delivery and transit damage |
|
Delivery is made to the address supplied by the Customer. Parcels and products should be inspected upon receipt. In the event of visible transit damage, the Customer is asked to record reservations with the carrier, retain photographs and contact SuissePliage promptly, ideally within 48 hours. This process does not remove rights relating to proven defect or non-conformity. |

Article 10 Installation and liability |
|
The Seller supplies the ordered metal components. Unless separately agreed, the Seller does not design, size or install the works. Checking product suitability, fastening, weather-tightness and installation safety is the responsibility of the Customer or installer, to the extent permitted by applicable law. |

Article 11 Defects, non-conformity and claims |
|
A defective product or one not conforming to the order may be submitted for return within 14 days of receipt, subject to prior contact at info@suissepliage.ch.
Modification or installation that caused the issue or prevents inspection may limit handling of a claim. |

Article 12 Warranty and remedies |
| Where a defect or non-conformity is accepted, the Seller may offer replacement or another solution agreed with the Customer. Liability for indirect costs, installation, removal, site downtime or business interruption is excluded to the extent permitted by applicable law. |
|
Article 13 Force majeure and impediments |
| The Seller is not liable for delay or non-performance caused by events beyond reasonable control, including supply interruption, transport disruption, fire, strike or natural disaster, subject to applicable law. |
|
Article 14 Intellectual property |
| Content, visuals, drawings, configurators, files and calculation tools available on the website remain protected and belong to their respective rights holders. Any unauthorised reproduction or commercial use is prohibited. |
|
Article 15 Governing law and jurisdiction |
| These Terms are governed by Swiss law. Subject to mandatory venues and applicable protections, jurisdiction lies at the Seller's registered office. |

ARTICLE 02 Custom products |
| Products include folded sheet metal, flashing and cladding parts made to Customer dimensions. Configured products are custom-made products. |

ARTICLE 03 Orders and dimensions |
| An order becomes binding after cart confirmation, acceptance of the Terms and payment confirmation. The Customer is responsible for dimensions, angles, quantities, material, thickness and finish. No engineering review is included unless expressly agreed. |

ARTICLE 04 Cancellation |
|
A custom product cannot be cancelled, returned or refunded for a change of mind after confirmation. Reservation: rights for defect, non-conformity and mandatory legal rights remain unaffected. |

ARTICLE 05 Tolerances |
A variation within tolerance or minor coating shade difference is not sufficient alone to establish non-conformity. |

ARTICLE 06 Prices |
| Prices are in CHF and, unless stated otherwise, exclude installation, studies, unlisted accessories and special delivery. The price accepted at order confirmation applies. |

ARTICLE 07 Payment |
| Payment is due with the order. Bank card, bank transfer and PayPal may be offered; checkout options prevail. Custom manufacture starts after payment confirmation. |
|
ARTICLE 08 Lead times |
| Unless agreed in writing, lead times are estimates. Mandatory rights and remedies applicable in case of delay remain reserved. |

ARTICLE 09 Delivery |
| Inspect goods on receipt. For visible transit damage: record reservations with the carrier, take photographs and contact us promptly, ideally within 48 hours. Proven defect or non-conformity rights are not removed. |

ARTICLE 10 Installation |
| Unless separately agreed, the Seller does not design, size or install the works. Suitability, fastening, weather-tightness and installation safety are the Customer's or installer's responsibility, to the extent permitted by law. |
|
ARTICLE 11 Claims |
|
A defective or non-conforming product may be submitted for return within 14 days of receipt after contacting info@suissepliage.ch. Modification or installation causing the issue or preventing inspection may limit a claim. |
|
ARTICLE 12 Warranty |
| For an accepted defect, the Seller may offer replacement or another agreed solution. Indirect, installation, removal or downtime costs are excluded to the extent permitted by law. |
|
ARTICLE 13 Force majeure |
| No liability for delay or non-performance caused by events beyond reasonable control, subject to applicable law. |
|
ARTICLE 14 Intellectual property |
| Site content, drawings, configurators and tools remain protected and belong to their rights holders. Unauthorised commercial use is prohibited. |
|
ARTICLE 15 Governing law |
| Swiss law applies. Subject to mandatory venues and protections, jurisdiction lies at the Seller's registered office. |
